These Terms of Use govern access to and use of LinkzzeyTV.com, including its pages, graphics, images, embedded features, links, and other content or functionality collectively referred to as the “Website.”

By accessing or using the Website, you agree to these Terms. If you do not agree, you should not use the Website.

1. Ownership and Operation

LinkzzeyTV.com is personally owned and operated by Linkzzey. The Website is maintained by CoolAid on Linkzzey’s behalf. CoolAid’s maintenance of the Website does not grant CoolAid any ownership interest in LinkzzeyTV.com, its branding, its Website-specific design, or its content. The Website is operated personally and is not operated through a corporation, limited liability company, or other registered business entity.

2. Website Purpose and Access

The Website is provided for informational, creative, promotional, and entertainment purposes. Visitors may:

• Browse publicly available pages and content;

• View graphics, images, and other media;

• Follow links to Linkzzey’s social media accounts and external websites;

• Access Modrinth content;

• View or interact with embedded YouTube, Patreon, and TikTok features; and

• Access the official Linkzzey Discord server.

The Website does not provide user accounts, uploads, comments, public posts, purchases, direct payments, giveaways, contests, or other user-submission features. Subject to these Terms, visitors receive a limited, revocable, non-exclusive, and non-transferable right to access and view the Website for lawful, personal, and noncommercial purposes. No ownership rights are transferred to visitors.

3. Intellectual Property Ownership

Except where expressly stated otherwise, all original graphics, images, artwork, logos, designs, written content, videos, Website-specific materials, and other original content appearing on LinkzzeyTV.com are owned by Linkzzey.

Some works may identify the individual who created them. Creator attribution is provided in the following or a substantially similar format:

This credit recognizes the creator’s contribution but does not indicate that the creator retains copyright ownership.

Third-party platforms, software, interfaces, trademarks, embeds, and services appearing on or accessible through the Website remain the property of their respective owners. Linkzzey does not claim ownership of YouTube, Patreon, TikTok, Modrinth, Discord, other social media platforms, or their technologies and branding.

4. Creator Credits

When sharing or modifying Website content, visitors must provide proper credit to:

• Linkzzey or LinkzzeyTV as the owner and original source; and

• Any creator identified on the original work.

Where reasonably practical, credit should also include a link to LinkzzeyTV.com or the relevant official Linkzzey account.

Copyright notices, creator credits, signatures, and other ownership information may not be removed, hidden, cropped out, altered, or presented in a misleading manner.

5. Permitted Uses

Visitors may, without advance permission:

• Share links to LinkzzeyTV.com;

• Repost screenshots, commentary, posts, or other material that includes Website graphics as part of a larger work or discussion;

• Create edits, fan works, or derivative versions of Website graphics for noncommercial purposes; and

• Share permitted edits and derivative works with proper credit.

These permissions do not allow visitors to extract an original, unmodified graphic and use it as a standalone personal asset.

All permitted uses must:

• Be properly credited;

• Remain noncommercial;

• Preserve visible ownership and creator information;

• Avoid claiming ownership of the original material;

• Avoid implying sponsorship, approval, or an official relationship with Linkzzey; and

• Comply with applicable laws and platform rules.

6. Prohibited Uses

Unless Linkzzey provides prior permission through the official Discord ticket system, visitors may not:

1. Use an original, unmodified Website graphic as a standalone personal asset, including as a profile picture, banner, logo, overlay, thumbnail template, channel identity, or similar branding;

2. Sell, license, sublicense, rent, or otherwise commercially exploit Website content;

3. Place original or modified Website content on merchandise or other products offered for sale or distribution;

4. Redistribute original, downloadable, source-quality, or substantially identical copies for money, advertising revenue, subscriptions, donations, promotion, traffic, or other personal gain;

5. Monetize edits, derivative works, or fan works based substantially on Website content without prior permission;

6. Claim ownership or authorship of Website content;

7. Remove, obscure, alter, or misrepresent copyright notices, creator credits, signatures, or ownership information;

8. Use Linkzzey’s name, branding, graphics, or content in a way that falsely suggests endorsement, sponsorship, partnership, authorization, or official affiliation;

9. Create an impersonating website, account, product, service, or organization;

10. Scrape, extract, or bulk-download Website content through automated means;

11. Interfere with the Website’s operation, security, performance, or availability;

12. Attempt to gain unauthorized access to the Website, its hosting environment, administrative systems, or related services;

13. Introduce malware, harmful code, automated attacks, or other disruptive technology; or

14. Use the Website or its content for any unlawful, fraudulent, deceptive, or abusive purpose.

7. Permission Requests

Requests to use Website content beyond the permissions granted by these Terms must be submitted through the official Linkzzey Discord server:

Submitting a request does not grant permission. Permission must be expressly provided by Linkzzey or an authorized representative and may be subject to conditions, including attribution, platform, purpose, time, or noncommercial-use restrictions.

The business-inquiry email associated with Linkzzey is reserved for business inquiries and should not be used for permission requests, copyright concerns, misuse reports, or questions about these Terms.

The Discord ticket system is provided for ordinary communications and does not replace any formal method of legal service required by applicable law.

8. Linkzzey Branding

The names Linkzzey and LinkzzeyTV, together with their associated logos, graphics, slogans, visual identities, and brand elements, are brand identifiers and unregistered trademarks belonging to Linkzzey.

Visitors may refer to Linkzzey for legitimate commentary, discussion, reviews, attribution, or noncommercial fan content. However, these names and brand elements may not be used in a way that:

• Suggests an official or authorized account;

• Creates confusion regarding ownership or affiliation;

• Promotes a product, service, organization, or commercial activity without permission;

• Impersonates Linkzzey or a member of the Linkzzey team; or

• Misrepresents or damages the Linkzzey brand.

9. External Links and Embedded Services

The Website may contain links to or embedded features from independent third-party services, including:

• YouTube;

• Patreon;

• TikTok;

• Modrinth;

• Discord; and

• Linkzzey’s other social media platforms.

These services are independently owned and operated. Their own terms, privacy policies, cookie practices, account requirements, community rules, and age restrictions may apply.

A link or embed does not necessarily indicate that the external service sponsors, endorses, or is officially affiliated with Linkzzey or LinkzzeyTV.com.

Linkzzey does not control or guarantee the availability, accuracy, security, content, functionality, or continued operation of external services. Visitors access and use them at their own discretion.

10. Age Requirements

LinkzzeyTV.com does not impose a specific minimum age requirement for browsing the Website. This does not apply to Linkzzey's stream chats on Twitch, TikTok, and YouTube, where a 13-year-old age requirement is strictly enforced, in accordance with Twitch's Terms of Service

Other external services linked to or embedded on the Website may have their own age requirements or require permission from a parent or legal guardian. Visitors are responsible for complying with those requirements.

11. Website Availability and Changes

Linkzzey may modify, move, update, restrict, suspend, or discontinue any portion of the Website at any time.

Linkzzey does not guarantee that:

• The Website will always be available;

• Every page, link, embed, or feature will operate without interruption;

• All content will always be complete, current, accurate, or error-free; or

• External links and services will remain active or unchanged.

Availability may be affected by maintenance, technical problems, hosting issues, third-party platform changes, outages, or other circumstances.

12. Disclaimer of Warranties

To the fullest extent permitted by law, the Website and its content are provided on an “as is” and “as available” basis.

Linkzzey makes no express or implied warranty regarding the Website’s availability, reliability, accuracy, security, suitability, performance, or freedom from errors or harmful components.

Website content is provided for general informational and entertainment purposes and does not constitute legal, financial, medical, or other professional advice.

Nothing in these Terms excludes any warranty, right, or protection that cannot legally be excluded.

13. Limitation of Liability

To the fullest extent permitted by law, Linkzzey and individuals maintaining or assisting with the Website, including CoolAid, will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses arising from or relating to:

• Access to or inability to access the Website;

• Reliance on Website content;

• Website interruptions or technical issues;

• External links or embedded services;

• Actions or failures of YouTube, Patreon, TikTok, Modrinth, Discord, hosting providers, other social media platforms, or other third parties;

• Unauthorized access, malware, or security incidents outside Linkzzey’s reasonable control; or

• Changes to, suspension of, or discontinuation of the Website.

Nothing in these Terms limits liability that cannot lawfully be limited or excluded

14. Enforcement

Linkzzey may protect the Website, its content, and its branding through any lawful and reasonably available measure, including:

• Requesting removal of unauthorized content;

• Submitting copyright, trademark, or impersonation complaints;

• Contacting websites, hosting providers, search engines, or social media platforms;

• Restricting access where technically and lawfully possible;

• Revoking previously granted permission;

• Preserving evidence of misuse; and

• Pursuing available legal remedies.

Failure to enforce a provision immediately does not waive Linkzzey’s right to enforce it later.

15. Changes to These Terms

Linkzzey may revise these Terms at any time.

Revised Terms take effect immediately when published on LinkzzeyTV.com. The “Last Updated” date at the beginning of this page will identify the latest revision.

Linkzzey is not required to separately announce or individually notify visitors of changes. Visitors are responsible for reviewing these Terms periodically.

Continued use of the Website after revised Terms are published constitutes acceptance of the revised Terms.

16. Governing Law and Jurisdiction

These Terms and any dispute arising from or relating to the Website, its content, or these Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Subject to any mandatory rights or jurisdiction provided by applicable law, disputes must be brought before a court of competent jurisdiction located in British Columbia, Canada.

Visitors agree to submit to the jurisdiction of those courts for disputes relating to the Website or these Terms.

17. General Provisions

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, it will be interpreted or limited to the minimum extent necessary to make it enforceable where possible. The remaining provisions will continue in effect.

A delay or failure by Linkzzey to enforce a right or provision does not waive that right or provision.

These Terms constitute the complete agreement between visitors and Linkzzey regarding access to and use of LinkzzeyTV.com, except where separate written permission has been provided for a specific use.

Section headings are included for convenience and do not affect the interpretation of these Terms.
